What is the penalty for buying real vaccination certificates without vaccination?

Some Telegram chats sell illegal services and, as it turned out, among them there is the preparation of quite official certificates of vaccination. АиФ.ги I figured out how such a document differs from a fake one and what threatens the performers of the illegal service and their clients.

What are the “real” but illegal certificates?

If the usual forgery does not pass the check on the Unified Portal of Public Services and Functions (EPSU), then these certificates are of a different level-they are prepared by the doctors themselves and enter information about the alleged vaccination in a special state register (i.e. such documents are checked).

How the service is organized, the correspondent of the Telegram channel Baza found out, having made a “virtual” vaccination. It costs from 10 to 20 thousand rubles. The entire registration process is identical to the official one, with the exception of the injection itself-the ampoule with the vaccine is simply thrown out. To receive the certificate, the client must provide passport data and the SNILS number, as well as have a confirmed account on Public Services, in which they will create a “diary of observations”.

What motivates citizens to apply for such a service?

In Russia, the rate of vaccination is quite low. According to open sources, the proportion of vaccinated people in the country does not exceed 10%. At the same time, in many countries, this figure has already exceeded 20% -30%.

For this reason, some regions of Russia are considering the introduction of mandatory vaccination. Distrustful citizens are afraid of this prospect, some do not want to get vaccinated. In addition, to speed up the pace of vaccination and motivate Russians, the authorities organized sweepstakes with solid prizes. So, for example, in Moscow, among the vaccinated, a car will be played.

All this pushes those who are absolutely not ready to get vaccinated, to look for alternative ways and buy fictitious certificates.

What kind of punishment can follow for issuing an illegal certificate?

Despite the fact that the document is prepared by doctors according to all the rules, this is a serious offense-both on the part of the contractor and on the part of the customer, he explained АиФ.ги Lawyer of the Center for Medical Law Andrey Karpenko. As in the case of the usual fake certificate, here we are talking about forgery of the document, because the vaccination is not done in the end.

“There is intent on both sides, both the doctor and the patient, who understands perfectly well that he will not be given the vaccine, but the certificate will be issued. Here you can pick up three or four elements of an offense, ” the expert noted.

According to Article 327 of the Criminal Code of the Russian Federation, “Forgery, production or circulation of forged documents, state awards, stamps, seals or letterheads”, performers can be put in prison or imposed forced labor for up to two years.

Customers for the use of fakes can be fined up to 80 thousand rubles or in the amount of their income for six months, as well as arrested for up to six months or assigned mandatory work (up to 480 hours) or correctional labor (up to two years).

In addition, the owners of such fictitious documents endanger the lives of many people, explains Karpenko. They still remain a potential source of infection, although according to the certificate they should not. The creation of a certificate and its possession falls under Article 236 of the Criminal Code of the Russian Federation “Violation of sanitary and epidemiological rules”.

What is the threat under the article on violation of sanitary and epidemiological rules?

Here we are talking about provoking a mass disease or poisoning of people through negligence, as well as creating such a threat. For this, they are fined 500-700 thousand rubles, may be deprived of the right to hold a certain position for two or three years, or put (sent to work) for up to two years.

At the same time, if the violation leads to someone’s death, the punishment will be even stricter. This is, for example, if the owner of a fake certificate infects someone with a coronavirus, and they die from complications. In this case, the fine will increase to one to two million rubles (or in the amount of income for one to three years), and the prison term or forced labor will increase to three to five years.

The mitigating factor that the customer of the certificate did not assume someone’s death will not release him from responsibility.

Do the authorities fight the black market of certificates and can they detect forgeries?

The authorities are already aware of illegal sales of these certificates. The head of the State Duma Committee on Information Policy, Information Technologies and Communications, Alexander Khinshtein, sent a letter to the Prosecutor General’s Office with a request to monitor checks on the provision of such illegal services and take measures.

As Andrey Karpenko notes, the services may well calculate the violators.
