The Cabinet of Ministers has submitted to the State Duma a bill to amend the article of the Criminal Code of the Russian Federation on repeated beatings, the document is posted in the Duma electronic database.
The Cabinet of Ministers explained that currently the responsibility for beatings is divided depending on whether they are committed for the first time or repeatedly.
In this regard, it is proposed to supplement Article 116.1 of the Criminal Code with the second part, which provides for liability for beatings or violent acts that caused physical pain by a person with a criminal record for a crime committed with violence.
The proposed sanctions provide for mandatory work for up to 480 hours, or correctional labor for up to a year, or restriction of liberty for up to a year, or arrest for up to six months.
In April of this year, the Constitutional Court of Russia found Article 116.1 of the Criminal Code of the Russian Federation on beatings by a person subjected to administrative punishment inconsistent with the basic law of the country, and ordered the legislative authorities to change this rule in order to protect victims of domestic violence.
According to the decision of the Constitutional Court, it is impossible to ignore the previous conviction for this act, since it indicates the stability of the behavior of such a person and his tendency to resolve conflicts by violence.In addition, the court pointed out the need to develop a compensation mechanism for victims in whose cases this rule of the Criminal Code was previously applied.
Earlier, a law was adopted in the Russian Federation that transfers beatings inflicted on close relatives without harm to their health from the category of criminal offenses to administrative offenses if the offense was committed for the first time. The culprit is first brought to administrative responsibility, and in case of repeated beating – to criminal.
